Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. 2.
Learned counsel Mr. D.K. Ratha has entered appearance on behalf the informant. The vakalatnama filed on behalf of the informant is taken on record.

The petitioner is an accused in Special G.R. Case No.31 of 2022, pending in the Court of the learned Additional Sessions Judge-cum-Special Judge under POCSO Act, Keonjhar, arising out of Pandapada P.S. Case No.31 of 2022, for commission of alleged offences under Sections 363/366/376(2)(n) of IPC read with Section 6 of POCSO Act read with Section 3(2)(v)(va) of SC & ST (P/A) Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cum-
Special Judge under POCSO Act, Keonjhar by order dated 22.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the petitioner is in custody since 19.03.2022 and charge-sheet has been filed on 17.05.2022, hence further continuance of the petitioner in custody is unwarranted.

Learned counsel for the informant on instruction submits that he has no objection if the bail is granted. 7.
Perused the 164 Cr.P.C. statement of the victim. 8.
Considering the tenor thereof, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
