This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.274 of 2022, pending in the file of the learned S.D.J.M., Boudh, arising out of Boudh P.S. Case No.226 of 2022 dated 25.08.2022, for alleged commission of offences under Sections 420/465/468/471 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Boudh, by order dated 29.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 26.08.2022 on the allegation, that forging B.Ed certificate, he got appointment as a Junior Teacher
and it is further submitted that since the allegation is more or less based on documentary evidence, further continuance of the petitioner in custody is not justified.

Learned counsel for the State opposes the prayer for bail inasmuch as he submitted that during the course of investigation, the petitioner ought not to be released on bail. 7.
Considering the nature of allegations and the period in custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.
Additionally, it is directed that the petitioner shall appear before the jurisdictional police station once every week till submission of final form. The date and time of such appearance to be fixed by the learned Court in seisin over the matter. 9.
Accordingly, the BLAPL stands disposed of.
