This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

It is submitted on behalf of learned counsel Ms. Depali Mohapatra, that she has entered appearance on behalf of the informant. Registry is requested to trace the Vakalatnama and tag with the file. Name of Ms. Mohapatra be reflected in the file as well as in the cause list and also in the CMS of the Court. 4.

The petitioner is an accused in G.R. Case No.1200 of 2022, pending in the file of learned J.M.F.C., Aska, arising out of Aska P.S. Case No.573 of 2022, offence under Sections 341/354(D)(2)/195(A)/506 of IPC and is in custody since 16.09.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Aska by

order dated 29.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 7.

Considering the tenor thereof, this Court is not inclined to entertain this bail application at this stage. 8.

Liberty is granted to the petitioner to move the Court in seisin over the matter after filing of final form which shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

Accordingly, the BLAPL stands disposed of.
