Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 52(a) of the Orissa Excise Act, 2008. 4.
Considering the nature of the allegation, gravity of the offence and the facts of the case, it is directed that, in the event of arrest in connection with Lingaraj P.S. Case No.242 of 2022 corresponding to C.T. Case No.5813 of 2022 pending in the Court of learned S.D.J.M., Bhubaneswar, the Petitioner shall be released on bail by the Arresting Officer on such terms and conditions as the Arresting Officer shall deem just and proper in the facts and circumstances of the case, but subject to verification of Criminal
// 2 // Antecedents of the Petitioner. If it is found that there is more than one criminal antecedent of similar nature against the Petitioners, then this bail order shall stand automatically revoked. 5.
The ABLAPL is disposed of accordingly.
