Heard Mr. S.P. Mohanty, learned counsel for the petitioner, and Mr. S.N. Nayak, learned Additional Standing Counsel for the State. 3.
The petitioner has filed this writ petition seeking direction to the opposite parties to restore the residential house of the petitioner standing over Khata No. 62/91, Plot No. 357/417 of Mouza Tumbiguda and or to direct the opposite parties to pay adequate compensation in accordance with the provisions of the right to fair compensation and transparency in land acquisition, rehabilitation and resettlement Act, 2013.

Since the petitioner has already preferred an Appeal vide Annexure-9 registered as Appeal Case No. 1 of 2022 under Section 9 (1) of Odisha Public Premises (Eviction of Unauthorized Occupants) Act pending before District Collector & District Magistrate, Rayagada, the same shall be considered and disposed of. While considering the same, the subsequent facts, which have been taken place in the matter, the petitioner is permitted to bring the same to the notice of the appellate authority, so that the appellate authority shall apply his mind and dispose of the same by passing a reasoned order. Needless to say, the appeal which is pending shall be disposed of as expeditiously as possible, preferably within a period of three months from the date of communication of the order. 4.
