This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.241 of 2015, pending in the file of learned J.M.F.C., Reamal, arising out of Kundheigola P.S. Case No.39 of 2015, alleged commission of offence under Sections 363/366/376(1) of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Deogarh by order dated 19.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that he is in custody for more than one month and as charge sheet has already been filed on 09.04.2020; further continuance of the petitioner in custody is not warranted.

Perused the 164 Cr.P.C. statement of the victim which is on record.

Considering the tenor thereof and keeping in view the filing of charge sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking into account that the petitioner was an absconder, this Court directs the petitioner to appear before the jurisdictional police station once every week till conclusion of trial. First date and time of such appearance shall be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
