ORDER

1. Heard learned counsel for the Petitioners and the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioners anticipating an arrest for their alleged involvement in the offences U/s. 498-A/294/323/506/34, I.P.C.

3. The learned counsel for the Petitioners submitted that the Petitioners are ready and willing to remain with the Informant in order to lead a blissful married life irrespective of the past happenings and shall extend cooperation in all respect to the Informant and insisted to refer the matter for mediation for a complete outcome so as to make the rest of the married life smooth.

4. The Informant Opposite Party No. 2 being personally present in the Court reiterated her claim for return of the car as well as the keys of the shop room stand in her name. However, she too expressed her willingness for leading a blissful married life.

5. Having heard the Petitioners and the Informant in person so also their counsels and having regard to the facts and circumstances of this case, this Court feels it just and proper to advise the learned counsels for both the parties to appear before the Secretary, High Court Legal Services Committee for an effective mediation on or before 28th November, 2022 and submit a copy of this order to the Secretary, High Court Legal Service Committee. In such event the Secretary shall do well in taking up the matter for mediation through the trained mediators empanelled in the High Court.

6. It is also directed that the Petitioners shall cooperate with the Informant to make her staying in the house of her parents comfortable by providing the car as and when required and also give excess to the Informant to visit the shop stood in her name as and when she pleases to visit.

7. The Petitioners shall provide financial support necessary for the day to day affairs and maintenance of the Informant who is living with her child in the parental house till the matter gets resolved in order to imbibe a confidence in her for a smooth married life in future.

8. Under no circumstance the Petitioners shall pose inconvenience in providing the above services to the Informant until everything gets resolved and the duo live together.

9. With the above conditions, the Petitioners are directed to surrender before the court in seisin over the matter and move for bail within three weeks' hence, in which event the learned court below shall admit the Petitioners to bail on such terms and conditions deem just and proper besides the conditions as narrated

// 3 // above. Violation of any of the terms and condition observed, shall entail cancellation of the bail on the report of the Informant before the court in seisin over the matter.

10. The ABLAPL is disposed of accordingly.
