Mr. D.P. Dhal, learned Senior Advocate has appeared on behalf of the Petitioner by filing an appearance memo in Court. The same be kept on record.

Heard Mr. Dhal, learned Senior Advocate for the Petitioner and Mr. Gaya, learned counsel for the State.

The Petitioner is an accused in G.R. Case No.320 of 2022 pending on the file of learned S.D.J.M., Birmaharajpur, arising out of Subalaya P.S Case No.87 of 2022, for commission of offence under Sections 376(2)(n)/506 IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Sonepur by order dated 26.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the Petitioner is in custody since 13.07.2022 and as charge sheet has been filed since 09.09.2022, his further continuance in custody, taking into account the nature of allegation, is not warranted.

Learned counsel for the State opposes the prayer for bail. 7.

Perused the statement of the victim recorded under Section 164 Cr.P.C.

Taking into account the filing of the charge sheet, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 9.

Accordingly, the BLAPL stands disposed of.
