The Petitioner in this writ petition prays for a direction to the Chairman, State Transport Authority, Odisha, Cuttack-Opposite Party No.2 to consider his application dated 1st December, 2020 (Annexure-3) filed for temporary diversion of the inter-State route from Bhadrak to Kolkata via Laxmannath instead of Jamsola. 3.

Mr. Mohanty, learned counsel for the Petitioner submits that the Petitioner is a permanent permit holder of inter-State route from Bhadrak to Kolkata via Jamsola in respect of the vehicle bearing Registration No. OD-01-P-3827 (Stage Carriage). Due to some difficulty, the Petitioner has applied for permanent diversion of the route, which is pending for consideration. Since the Petitioner is facing difficulty to keep with timing slot, he filed an application before the Chairman, STA, Odisha, Cuttack for temporary diversion of the route through Laxmannath. Said application is pending with the authority since 1st December, 2020. He, therefore, prays for a direction for early disposal of the same.

Mr. Behera, learned Standing Counsel for Transport Department submits that he has no instruction on the same. However, if the application of Petitioner is stated to be pending before the authority, the same may be directed to be disposed of in accordance with law at an early date.

Considering the submissions made by learned counsel for the parties, this Court finds that application for temporary diversion of route was made on 1st December, 2020 (Annexure-3) and in the meantime, almost two years have elapsed.

In view of the above, this Court without expressing any opinion on the merits of the case disposes of this writ petition with a direction that in the event a fresh application for temporary diversion of route is made within two weeks hence along with certified copy of this order, the Chairman, STA, Odisha, Cuttack-Opposite Party No.2 shall do well to take a decision on the same in accordance with law as expeditiously as possible preferably within a period of four weeks therefrom and communicate the same to the Petitioner forthwith. Urgent certified copy of this order be granted on proper application.
