Heard Mr. D.K. Mohanty, learned counsel for the petitioner and Mr. S. Nayak, learned Additional Standing Counsel appearing for the State-Opposite Parties.

The petitioner has filed this writ petition seeking compassionate appointment under rehabilitation assistance scheme under OCS (RA) Rules, 1990.

Mr. D.K. Mohanty, learned counsel for the petitioner contended that the petitioner has already made representation vide Annexure-6, which is still pending for consideration. 5.

Mr. S. Nayak, learned Additional Standing Counsel appearing for the State-Opposite Parties contended that the petitioner has never applied in the prescribed format for giving compassionate appointment and, therefore, her case has not been considered by the authority.

Having heard learned counsel for the parties and after going through the records, this Court finds that the petitioner has not applied for compassionate appointment under prescribed format. Therefore, this writ petition stands disposed of granting liberty to the petitioner to approach the authority by filing application under

prescribed format within one month for compassionate appointment. If such application is filed, the authority shall consider the same and pass appropriate order within a period of four months from the date of filing of such application along with certified copy of this order.

With the aforesaid liberty, the writ petition stands disposed of.
