Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in C.T. Case No.546 of 2022, pending in the file of learned S.D.J.M., Bhawanipatna, arising out of Kegaon P.S. Case No.94 of 2022, for commission of alleged offences under Sections 379/34 of IPC.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna by order dated 13.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the petitioners are in custody since 04.06.2022 and as charge sheet has already been filed on 13.08.2022, further continuance of the petitioners in custody is not warranted.

Keeping in view the nature of allegations and taking into account the punishment prescribed, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view their criminal proclivity of the petitioners, it is directed that they shall appear before the jurisdictional police station once every week on such date and time to be fixed by the learned Court in seisin till conclusion of trial. 7.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
