This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.1305 of 2022, pending in the Court of the learned S.D.J.M., at Bhanjanagar, Ganjam, arising out of Bellaguntha P.S. Case No.267 of 2022, for alleged commission of offences under Section 379 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhanjanagar, by order dated 26.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations and that the basis of implication is on account of the confessional statement of the co-accused and the punishment prescribed, this Court directs the

petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

6.

Accordingly, the BLAPL stands disposed of.
