Heard learned counsel for the Parties.

There is no dispute that the election of the Association is being conducted through the Election Officer. There is also no dispute that the Election Officer is functioning in his private capacity but in terms of the Memorandum of Article of the Association. In the circumstance and for no discharge of public duty by the Election Officer, this Court finds difficulty in entertaining Writ Petition, which is dismissed. 3.

Dismissal of the Writ Petition as not maintainable shall not, however, stand on the way of the Petitioner to pursue his remedy before any other available forum.
