This matter is taken up through hybrid mode.

The Petitioner has come up in this writ petition assailing the provisional assessment order issued by the Assessing Officer-cumS.D.O. (Electrical), Raghunathpur Electrical Sub-Division, TPCODL-Opposite Party No.2.

It is submitted by Mr. Mishra, learned counsel for the Petitioner that although thirty days have already elapsed in the meantime from the date of service of provisional assessment order, no final order on such assessment has yet been passed by the authority. Thus, no action on the provisional assessment order can be taken in view of Section 126 (3) of the Electricity Act, 2003 and Regulations 161 and 165 of the Odisha Electricity Regulatory Commission Distribution (Conditions of Supply) Code, 2019. 4.

Since the provisional order of assessment is under challenge in this writ petition, this Court is not inclined to entertain the same. It is open to the Petitioner to appear before the Assessing Officer-

// 2 // Opposite Party No.2 and contest the provisional assessment order by filing his objection, if the assessment proceeding is still pending. 5.

With the aforesaid observation, this writ petition is disposed of.
