The Petitioner in this writ petition seeks to assail the notice of eviction dated 6th October, 2022 (Annexure-3) issued by the Managing Director, Odisha State Textile Corporation Ltd., Jharsuguda-Opposite Party No.2.

Mr. Das, learned counsel submits that the Petitioner was an exemployee of Bhaskar Textile Mills Ltd., which has since been closed. However, he is residing in Qr. No.J/2 of BTM Colony. In that respect, the Petitioner has already been recognized as a slum dweller under Usha Survey conducted by Jharsuguda Municipality. Hence, he is entitled to occupy the said quarter. In that regard, the Petitioner has made a representation dated 11th October, 2022 to the Managing Director, Odisha State Textile Corporation Ltd., Jharsuguda as at Annexure-5, but as yet no decision has been taken on the same. 4.

Considering the submission of learned counsel for the Petitioner and in view of Section 6 of the Odisha Land Rights to Slum Dwellers Act, 2017, the Petitioner has to make an application to the Collector, Jharsuguda for settlement of the land.

Accordingly, this writ petition is disposed of with an observation that in the event the Petitioner makes an application to the Collector, Jharsuguda-Opposite Party No.1 within a period of two weeks hence along with certified copy of this order, his case shall be considered in accordance with law.

Urgent certified copy of this order be granted on proper application.
