This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438 of Cr.P.C. in connection with Jagatsingpur P.S. Case No. 642 of 2021 corresponding to C.T. Case No. 211 of 2021 pending in the Court of learned Sessions Judge -cum- Special Judge, Jagatsingpur for offences punishable under sections 21(c)/29 of the N.D.P.S. Act.

// 2 // It appears that the petitioners earlier moved this Court for grant of anticipatory bail in ABLAPL No. 16838 of 2021 and this Court as per order dated 27.01.2022 rejected the same on the ground that commercial quantity of brown sugar was seized from the possession of the petitioners and keeping in view the bar under section 37 of the N.D.P.S. Act and liberty was granted to the petitioners to surrender in the Court below and move for bail. Without complying the said order, the petitioners again moved this Court for grant of anticipatory bail on the ground that some of the co-accused persons have been released on bail and charge-sheet has already been submitted.

Considering the submissions made by the learned counsel for the respective parties, I do not find any change in the circumstances to again consider this application for grant of anticipatory bail. Accordingly, the prayer made in the application stands rejected. The ABLAPL stands disposed of.
