This matter is taken up through Hybrid Mode.

The aforesaid CRLMC has been filed for quashing of the proceeding in G.R. Case No.293 of 2019 on the file of Learned J.M.F.C., Buguda arising out of Buguda P.S. Case No. 306 of 2019.

Heard Mr. Jyotirmaya Sahoo, learned counsel for the petitioners, Mr. D. Mund, learned Additional Government Advocate for the State and Mr. J.K. Khandayatray, learned counsel appearing for the Opposite Party No.2 4.

Learned counsel for the petitioners and learned counsel for the Opposite Party NO.2 submit that, the matter has been settled out of Court.

The informant-Opposite Party No.2 is present in Court. On being asked states that, he supports the stand of the petitioners that the matter has been settled and he does not want to proceed with the case.

In fact, an Affidavit filed by the informant-Opposite Party No.2 to the said effect is taken on record. It is stated in the said affidavit inter alia that, the informant-Opposite Party No.2 has no objection, if this Court allows the CRLMC and directs for quashing of the order of cognizance.

Taking into account the assertions made in the affidavit and on hearing the counsels for the parties and in tune with the law laid down by the Apex Court in case of Parbatbhai Aahir alias Parbatbhai Bhimsinhbhai Karkur and others v. State of Gujarat and another, reported in AIR 2017 SCC 4843, the proceeding in connection with G.R. Case No.293 of 2019 on the file of Learned J.M.F.C., Buguda arising out of Buguda P.S. Case No. 306 of 2019 stands quashed, in exercise of power Under Section-482 Cr.P.C.

The CRLMC thus stands disposed of.

Urgent certified copy of this order be granted as per rule. ( V.Narasingh ) Balaram Judge
