It is agreed by learned counsel for the parties that the issue involved in this case is analogous to W.P.(C) No.14856 of 2014 (Abhishek Dey & Ors. v. District & Sessions Judge, Mayurbhanj & Anr.), which has been disposed of vide order dated 04.03.2016 by this Court.
