This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No.259 of 2022, arising out of Naikanidihi P.S. Case No.70 of 2022 pending in the Court of learned J.M.F.C., Basudevpur for commission of offence punishable under Sections 341/294/323/324/307/506 and 34 of IPC.

This Court does not find any reason to entertain this bail application afresh notwithstanding the submission of the learned counsel for the petitioners that in the meanwhile charge sheet has been filed inter alia under Section 307 of IPC. 5.
It shall be open to the petitioners to move the learned Court below referring to the release of the co-accused and bringing
to the notice of the learned Court in seisin filing of charge sheet inter alia under Section 307 of IPC and the same shall be considered on its own merits.

Accordingly, the ABLAPL stands disposed of 7.
