1. Heard learned counsel for the Petitioner and the State.
2. This is an application for bail U/s. 438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences U/s. 294/292/500/354-C/354-D/506 of IPC.
3. Perusal of the order of this Court dated 14th October, 2022 reveals that a direction was given for settlement of the dispute through Mediator.
4. It is contended by the learned counsel appearing on behalf of the Informant that despite being called for a resolution, the Petitioner did not turn up to the Police Station. It is also contended that taking advantage of the interim protection, the Petitioner is not resorting to any kind of resolution of the dispute.
5. Keeping in view the submission of the parties, the nature of allegations as emerged from the materials on record, the circumstances appearing, the seriousness and gravity of the
// 2 // offences, it is directed that in the event the Petitioner surrenders and moves for bail in connection with Dhamnagar P.S. Case No. 344 of 2022 corresponding to G.R. Case No.615 of 2022 pending in the court of learned J.M.F.C.
, Dhamnagar within a period of three weeks hence and he shall be admitted to go on bail on such terms and conditions as would be deemed just and proper by the said court with further conditions that the Petitioner shall appear in person before the learned court below on each date of posting of the case; shall furnish an undertaking before the court in seisin over the matter to the effect that he shall not come on the way of the Informant in any manner either through Social Media/ Mobile or on her way to college or other places in making any attempt to outrage her image in the public in any manner; shall appear before the I.O.
and shall cooperate with the investigation as and when required; shall not threaten, intimidate or terrorize the Informant and her family; shall not tamper with the prosecution evidence in any manner whatsoever and shall not indulge in any other crime of similar nature to the present case, in any manner whatsoever, while on bail. Violation of any of the conditions shall entail cancellation of bail.
6. The ABLAPL is disposed of accordingly.
