Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.1008 of 2022 pending on the file of learned S.D.J.M., Jajpur, arising out of Ramachandrapur P.S. Case No.118 of 2022 3.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C by the learned Sessions Judge, Jajpur by order dated 20.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is stated that the Petitioner is in custody since 29.04.2022 and charge sheet has been filed on 21.08.2022 under Sections 498-A/304-B IPC and Section 4 of the D.P Act. 5.
Learned counsel for the Petitioner states that during investigation, the dying declaration of the deceased was recorded.

On going through the same, it is seen that the deceased said that the unfortunate incident happened accidentally and no one is responsible for the same.

Considering the same, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
