Heard Mr. U.K. Samal, learned counsel for the petitioner and Mr. J.P. Pattnaik, learned Government Advocate. 3.

The petitioner has filed this writ petition seeking to quash the disciplinary proceeding initiated against him under Annexure1, and to issue direction to the opposite parties to release the retirement dues with 18% interest and further direct to pay reasonable compensation within a stipulated time. 4.

Mr. U.K. Samal, learned counsel for the petitioner contended that during pendency of the writ petition, the disciplinary proceeding initiated against the petitioner has already been concluded, vide office order dated 07.11.2019. Therefore, the petitioner is entitled to get the financial benefits as due and admissible to him. Therefore, it is contended that the petitioner may be permitted to file a fresh representation before the opposite party no.2 highlighting the grievances and direction may be given to consider the same within a stipulated time, to which learned State Counsel has no objection.

As agreed to by learned counsel for the parties, however, without expressing any opinion on the merits of the case, this writ

petition stands disposed of with the direction that in case the petitioner, with regard to the grievance made in this petition, files a fresh comprehensive representation before the opposite party no.2, within fifteen days hence, the said authority shall consider the same and pass a reasoned and speaking order, as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with the certified copy of this order.

Issue urgent certified copy as per rules.
