This matter is taken up through Hybrid Mode.

Heard Mr. S.K. Choudhury, learned counsel for the petitioner and Mr. Imran Khan, learned counsel appearing for the Opposite Party.

The aforesaid CRLMC has been filed for quashing of the proceeding in G.R. Case No.1369 of 2019 on the file of Learned S.D.J.M.(Sadar), Cuttack During pendency of the CRLMC with the intervention of the well-wishers from both the sides, the matter is stated to have been compromised and settled out of Court.

An affidavit filed by the Opposite Party dtd. 17.05.2022, the same is taken on record.

Paragraph No. 9 of such affidavit indicating that the matter has been compromised interse is quoted hereunder for convenience of ready reference;

"That basing on the aforesaid compromise and receipt of full amount as stated above, I have no objection if the proceedings initiated by me against the petitioner and others as stated above now pending before the learned JMFC, Cuttack and SDJM, Sadar, Cuttack are quashed by this Hon'ble Court as is prayed for in the aforementioned CRLMC by the petitioner."

In view of the recitals in the aforesaid paragraph and in tune with the law laid down by the Apex Court in case of Parbatbhai Aahir alias Parbatbhai Bhimsinhbhai Karkur and others v. State of Gujarat and another, reported in AIR 2017 SCC 4843, the proceeding in connection with G.R. Case No.1369 of 2019 on the file of Learned S.D.J.M.(Sadar), Cuttack stands quashed in respect of the petitioner, in exercise of power under Section-482 Cr.P.C.

The CRLMC thus stands disposed of.
