This matter is taken up through hybrid mode.

This is an application filed by the Petitioners seeking recall of the order dated 27th October, 2022 by which the CMP was disposed of.

Mr. Mohapatra, learned counsel Opposite Parties submits that in view of liberty granted to the Opposite Parties in the CMP, this application to recall the order dated 27th October, 2022 has been filed.

Mr. Bose, learned counsel, who was appearing for the Petitioners in the CMP, submits that he has no instruction to appear on their behalf in the I.A.

In view of the above, if notice is issued, the matter will be delayed and in that process, disposal of FAO No. 41 of 2022 will be delayed, which will enure to the benefit of none. 6.
Accordingly, this Court without delving into the merits of the I.A. disposes of the same with a direction to the learned District Judge, Puri to dispose of the appeal, i.e. FAO No. 41 of
// 2 // 2022, as expeditiously as possible preferably within a period of six weeks from the date of production of certified copy of this order giving opportunity of hearing to the parties concerned and complying with the direction made in the order dated 27th October, 2022 by which the CMP was disposed of. Urgent certified copy of this order be granted on proper application.
