Mr. Acharya, learned advocate appears on behalf of petitioner and submits, the writ petition is covered by order dated 23rd December, 2021 made by this Bench in W.P.(C) no.35437 of 2020 (Leka Consulting Services Private Limited v. National Company Law Tribunal, Cuttack and another). He submits, the petition be dealt with accordingly.

On query from Court Mr. Acharya points out from, inter alia, paragraphs 10 and 13 that in this case too the Registrar of Companies (ROC) mentioned that his client be put to strict proof of the contention that the company, at the time of its striking out, was in operation.
