The matter is taken up through hybrid arrangement Order No.

(virtual/physical) mode.

This is the second journey of the Petitioner who is in custody in connection with Hemgir P.S. Case No.127 of 2016 corresponding to S.T. Case No.127 of 2016 arising out of G.R. Case No. 848 of 2017 on the file of learned District & Sessions Judge, Sundargarh for alleged commission of offence under Section -366/370(2)/323/379/376(2)(b)/34 of the IPC, in filling this application under section 439, Cr.P.C. for reconsideration of the prayer for grant of bail to the Petitioner in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made and on going through the materials on record including the deposition of the Informant already examined in the trial as also viewing other surrounding circumstances; at this stage of the trial, I am not

// 2 // inclined to reconsider the prayer for grant of bail to the Petitioner.

It is, however, observed that the Trial Court would do well to take all such effective steps as provided in law for early conclusion of the trial, preferably within a period of six months from today and in the event, within the period stipulated, the trial is not concluded, the Petitioner if so advised may renew his prayer for reconsideration of the prayer for grant of bail. 5.

The BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
