This matter is taken up through hybrid mode.

Order No 2.

Heard learned counsel for the Petitioner and learned counsel appearing for the State-Opp. Parties.

The Petitioner has filed the present writ petition with the following prayer:- "Direct the Opposite Parties to grant/sanction the retirement benefits, i.e. pension, gratuity, unutilized leave salary, commuted value of pension and revised arrear dues of the Petitioner by regularizing the period of suspension from 28.05.2010 to 28.09.2011 as duty, in view of the acquittal of the Petitioner vide Judgment dated 08.10.2021 and thereby grant annual periodical increments from 2010 to till retirement, and the RACP benefits, as has been given to other similar situated persons;

(ii) pass such other order(s)/direction(s) as may be deemed fit and proper in the bonafide interest of justice."

Learned counsel for the Petitioner submits that the Petitioner has already ventilated his grievance by filing a representation before the Opposite Party No.1 on 23.12.2021 under Annexure-5 to the writ petition, but till date nothing has been done on the same. In such background, learned counsel for the Petitioner prays that a direction be issued to the Opposite Party No.1 to take a decision on the above noted representation of the Petitioner within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Opposite Party No.1 to take a decision on the representation of the Petitioner under Annexure-5 to the writ petition taking into account Annexure-4 to the writ petition within a period of three months from the date of receipt of this order and communicate the result of such exercise to the Petitioner.
