This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.265 of 2022, pending in the Court of the learned S.D.J.M., Paralakhemundi, arising out of Seranga P.S. Case No.42 dated 07.06.2022, for alleged commission of offences under Section 420/465/468/471 of IPC read with Section 66(C)/66(D) of I.T. Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Gajapati, Paralakhemundi, by order dated 29.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 27.08.2022 and as investigation

has progressed substantially, further detention of the petitioner in custody is unwarranted.

Taking into account that the allegation against the petitioner is that he received Rs.60,000/-(Rupees sixty thousand) from the informant in two installments for providing job in the State Bank of India and when the cheques were presented, the same were dishonored and considering the allegations made and the period of custody as stated, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.

Additionally it is directed that the petitioner shall deposit cash security to the tune of Rs.30,000/-(Rupees thirty thousand) which shall be kept in a short term interest bearing account to be pledged in the Court in seisin over the matter and shall abide by the outcome of the trial.

Accordingly, the BLAPL stands disposed of.
