This matter is taken up through hybrid mode.

This CMP has been filed with a prayer to target the disposal of Civil Suit No. 153 of 2016 pending before learned Civil Judge, Senior Division, Sambalpur.

Learned counsel for the Petitioner submitted that the suit is pending since last 7 years. Notice of the Defendants is not yet made sufficient. Due to Lawyers strike at Sambalpur, the suit could not proceed. Due to pendency of the suit the Petitioner who is the plaintiff is seriously prejudiced. Hence, this CMP has been filed.

Submission of learned counsel for the Petitioner makes it clear that the suit is not ready for hearing. It is also not clear as to why the plaintiff has not taken appropriate steps on the Defendants as yet. The submission that the suit is lingering due to Lawyers strike at Sambalpur, cannot be a ground to direct early disposal of the suit.

In view of the above, this Court finds that the prayer made in this CMP merits no consideration.

Accordingly, the CMP being devoid any merit stands dismissed.
