None appears for the petitioner at the time of call. Heard Mr. S. Rath, learned Additional Standing Counsel for the State. Perused the record.

The petitioner has filed this writ petition seeking to direct the opposite parties to finalize the regular pension as per ORSP Rules, 2006 and to release all the retiral benefits pending with the opposite parties such as commuted value of pension, DCRG and other arrears as per ORSP Rule, 2016 with interest @ 7% per annum as prescribed under Rule 49 (5) of OCS (Pension) Rules, 1992. 4.
Mr. S. Rath, learned Additional Standing Counsel for the State contended that since the vigilance case bearing VGR Case No. 17 of 2009 corresponding to T.R. Case No. 50 of 2010 is pending before the Special Judge (Vigilance), Bhubaneswar and charge sheet has been submitted after 31.08.2010, therefore, the benefit has not been extended to the petitioner.

In view of the above, the writ petition stands disposed of giving liberty to the petitioner to pursue his remedy after disposal of the vigilance case, which is pending before the court below, if he is so advised.
