This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned Addl. Standing Counsel.

Perused the case record. The petitioners are in custody since 18.09.2021 in connection with Angul Sadar P.S. Case No. 563 of 2016 corresponding to G.R. Case No. 1279 of 2021 of the Court of learned S.D.J.M., Angul for the alleged commission of offence under Sections 341/294/323/307/ 379/34 of IPC.

As per the prosecution allegation, the petitioners assaulted the informant on his head by means of a beer bottle causing injury.

Learned counsel for the petitioner submits that the matter has arisen out of a petty quarrel, in course of which the petitioners being enraged committed the alleged act. 6.

Learned Addl. Standing Counsel, on the other hand, has opposes the prayer for bail by submitting that the petitioners are habitual offenders and there are several criminal cases in

their names.

Having regard to the nature of allegations and the fact that all the injuries sustained by the informant are simple in nature as also having regard to the fact that both the petitioners are permanent residents under Angul Sadar Police Station, I am inclined to allow the prayer for bail. Let the petitioners be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that they shall personally appear before the IIC, Angul Sadar Police Station on every Monday at 10.30 a.m. till submission of charge sheet.

BLAPL is accordingly disposed of.
