Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1040 of 2022, pending in the Court of learned S.D.J.M., Baripada, arising out of Suliapada P.S. Case No.100 of 2022, for commission of alleged offences under Sections 420/468/472 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge (Vigilance), Baripada, by order dated 25.08.2022 in the aforementioned case, the present BLAPL has been filed. 4.

It is submitted by the learned counsel that the petitioner is in custody since 23.06.2022 and charge-sheet has been filed on 20.08.2022.

It is stated that the petitioner while working as Assistant Branch Post Master from the year 2016 to 2020 of Kaduani Post

Office is alleged to have issued four fake KVP passbooks and in the process, has misappropriated a sum of Rs.4,87,000/-(Rupees four lakh eighty seven thousand).

It is stated that the allegation is more or less based on documentary evidence and as charge-sheet has already been filed, further continuance of the petitioner in custody is unwarranted. 7.

Taking into account the period of custody and the nature of allegations, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
