Heard learned counsel for the petitioner and learned Addl. Standing Counsel.

The petitioner is in custody since 08.09.2021 in connection with Subabeda P.S. Case No. 146 dated 07.09.2021 corresponding to G.R. Case No. 747 of 2021 of the Court of learned S.D.J.M., Koraput for the alleged commission of offence under Sections 294/307/326/506/34 of IPC. 4.
The prosecution allegation is that on the date of occurrence, the petitioner being associated with several other persons armed with deadly weapons, abused and assaulted the informant and his friends causing bodily injury. 5.
It is submitted by learned counsel for the petitioner that the allegations are omnibus in nature and the injury reports of police requisition do not support the allegation that the petitioner had made any attempt to kill the informant and the injured persons.

Learned Addl. Standing Counsel on the other hand has opposed the prayer for bail by submitting that the investigation into the case is in progress and the injured persons had received grievous injuries.

Having regard to the nature of allegations and the fact that the occurrence appears to have arisen in course of a scuffle between two groups and nothing specific has been attributed to the present petitioner, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the IIC, Sunabeda Police Station on every Monday at 10.30 a.m. till submission of Final Form. 8.
BLAPL is accordingly disposed of.
