This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are the accused in connection with T.R Case No.110 of 2022, pending on the file of the learned Special Judge-cum-Addl. Sessions Judge, Koraput, arising out of Pottangi P.S. Case No.129 of 2022 for the alleged commission of offence under Section 20(b)(ii)(C)/29 of the N.D.P.S. Act. 4.
Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge-cumSpecial Judge, Koraput by order dated 11.10.2022, the present BLAPL has been filed.

Since consideration was during currency of the investigation, notwithstanding the submission of the learned counsel for the Petitioners that it is a case of false implication by
the police officials and taking into account that the contraband (ganja) seized is more than commercial quantity, the role ascribed to the Petitioners and in view of the bar contained in Section 37 of the N.D.P.S Act, this Court is not inclined to entertain the bail application.

Accordingly, BLAPL stands rejected. It shall be open to the Petitioners to renew their prayer before the court afresh post charge sheet and the same shall be considered on its own merits. (V. NARASINGH) Judge PKS
