Heard Mr. B.K. Parida-2, learned counsel for the petitioners. 3.

Against remand order in revision, the matter is pending before the Tahasildar, Baliguda. When the matter is so pending, it is contended that steps have been taken by the authority to evict the petitioners from Khata No.771, Plot No.270 measuring an area of Hec.0.056R out of total area of Hec.14850R of Kisam-Anabadi (Patita) of Mouza-Baliguda, Tahasil-Baliguda in the district of Kandhamal.

At the outset, this Court is not inclined to entertain this writ petition, as the matter is sub-judice before the Tahasildar, Baliguda. If any step is taken by the authority for eviction, it is open to the petitioners to pursue their remedy before the Tahasildar apprising all the facts, so that same can be taken into consideration by the said authority and pass appropriate order in accordance with law. 5.

With the above observation, the writ petition stands disposed of.
