This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

As directed, the postal tracking report furnished by the registry, which shows that the notice was served on the informant on 11.11.2022.

The petitioner is in custody since 16.09.2022 in connection with Jajpur Sadar P.S. Case No.261 of 2020 corresponding to C.T. Special Case No. 134 of 2020 pending in the Court of learned District & Sessions Judge-cum-Special Judge, Jajpur for the alleged commission of offence under Sections 3(2)(va) of SC & ST (P.A.) Act.

It is alleged that the petitioner and some other persons assaulted the deceased by means of lathis causing his death. In so far as the present petitioner is concerned, it appears that in a dispute between two groups the petitioner was part of the group that had assaulted the deceased. The statement of the witnesses does not specifically implicate the petitioner by attributing any overt act save and except that he along with others assaulted the deceased by
means of lathis. The co-accused persons, namely, Sudhansu Sekhar @ Pinku Mohapatra and Sudhir Kumar Rout have been granted bail as per the order passed by this Court in CRLA No. 151 of 2022. This Court therefore, finds no reason to treat the petitioner differently than them.

Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

CRLA is accordingly disposed of.
