This matter is taken up through hybrid mode.

The Petitioner in this CMP seeks for a direction for early disposal of C.S. No.43 of 2015 pending before learned Senior Civil Judge, Khurda.

Mr. Behera, learned counsel for the Petitioner submits that the Defendants have already appeared and filed their written statement. Trial of the suit has also commenced and the suit was last posted to 17th August, 2022 for adducing evidence on behalf of Defendants. During pendency of the suit, the Petitioner, who is a widow, is suffering a lot. Hence, this CMP has been filed for the aforesaid relief.

The submission of Mr. Behera, learned counsel for the Petitioner and perusal of Annexure-2 make it clear that the suit is posted for adducing evidence on behalf of Defendants. Hence, parties should cooperate with learned trial Court for early disposal of the suit, if there is no legal impediment. Thus, this CMP is disposed of with an observation that learned trial
