This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel appearing for the State-Opp. Parties.

The Petitioner has filed the present writ petition with the following prayer:- "The Opposite Parties be directed to allow the petitioner to avail the benefits of 3rd RACP with the Grade Pay of Rs.6600/- w.e.f. 1.1.2013 on completion of 30 years of service in accordance with the provisions of the ORSP Rules, 2008 with all other consequential benefits since similar benefits have been sanctioned to the similarly situated employees as per the order at Annexure-9, 10 & 12 and the amounts so due may be drawn & disbursed with arrears after re-fixation of his pay to him as a consequential benefit at an early date in accordance with the settled principle of law.

// 2 // And further be pleased to pass such other writ(s)/order(s) as may deem just and proper." 4.

Learned counsel for the Petitioner submits that the Petitioner has already ventilated his grievance by filing a representation before the Opposite Party No.2 on 30.08.2022 under Annexure-13 to the writ petition, but till date nothing has been done on the same. In such background, learned counsel for the Petitioner prays that a direction be issued to the Opposite Party No.2 to take a decision on the above noted representation of the Petitioner within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Opposite Party No.2 to take a decision on the representation of the Petitioner under Annexure-13 to the writ petition taking into account Annexures-11 and 12 to the writ petition within a period of three months from the date of receipt of this order and communicate the result of such exercise to the Petitioner. 6.
