Heard learned counsel for the petitioner and learned counsel for the State.

In fact, the present application has been filed by the petitioner seeking modification of one of the conditions of the order dated 11th January, 2022 passed in BLAPL No.9039 of 2021 which is to the effect that he shall not leave the jurisdiction of the court without its prior permission.

Learned counsel for the petitioner submits that due to such a condition imposed, the petitioner is facing a lot of difficulty and therefore, it should be modified/deleted. On the other hand, learned counsel for the opposite party, Mr. A.P. Mishra submits that the petitioner, considering the nature of offences alleged, should not be allowed to leave the State unless there has been permission obtained from the concerned court. It is further submitted that there should be a

// 2 // direction from the Court that the petitioner shall cooperate in the investigation as and when directed. However, no application has been moved in that behalf. If in the event, any such application is filed from the side of the opposite party for such a condition imposed, it would be considered by the Court.

In so far as, the modification of condition is concerned, it only needs a clarification. Resultantly, it is directed that the condition that the petitioner shall not leave the jurisdiction without prior to the court to be read as not to leave the State without such permission of the concerned court.

Accordingly, the I.A. is disposed of.
