This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner.

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioner for bail in connection with Bisamkatak P.S.Case No.34 of 2021, corresponding to T.R. Case No.48 of 2021, pending in the Court of the learned Additional Sessions Judge-cum-Special Judge, Gunupur for alleged commission of offence under Sections 20(b)(ii)(i)/29 of the N.D.P.S.Act 4.

Learned counsel for the Petitioner does not want to press this bail application at this juncture and prays that the trial court be directed to expedite the trial and the same be concluded within a stipulated period of time.

Considering the aforesaid submissions, while disposing of the bail application of the Petitioner as withdrawn, this Court directs the trial court to expedite trial and conclude the same within a period of six months. In the event trial is not concluded within the aforesaid

// 2 // period, it is open for the Petitioner to move an application for bail and in the event such a bail application is filed the same shall be considered in accordance with law.
