This matter is taken up through virtual/physical mode. 2.

The Original Application No.2118 of 2018 was filed before the Orissa Administrative Tribunal, Bhubaneswar Bench, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OA) No.2118 of 2018.

The petitioner on the death of his father on 08.03.1996 who was serving as Senior Clerk in the office of Collectorate, Kalahandi, approached the appropriate authority for consideration of his appointment under the provisions of Orissa Civil Service (Rehabilitation Assistance) Rules, 1990. Enclosing the order of Odisha Administrative Tribunal dated 08.04.2016 passed in O.A. No.3182 (C) of 2010, the petitioner has approached the Odisha Administrative Tribunal again in O.A. No.2118 of 2018. Essentially, the petitioner sought for implementation of order dated 08.04.2016 passed

// 2 // in O.A. No.3182 (C) of 2010. After abolition of Odisha Administrative Tribunal, the said O.A. No.2118 of 2018 has been converted to writ petition bearing WPC (OA) No.2118 of 2018, which is listed for hearing today.

At the time of hearing, Ms. Priti Nanda Pattnaik, learned counsel for the petitioner submitted that the State had challenged the order dated 08.04.2016 passed in O.A. No.3182 (C) of 2010 by the Odisha Administrative Tribunal. Said case was registered as W.P.(C) No.16122 of 2018. Learned counsel for the petitioner further submitted that the said case has been dismissed by the Division Bench of this Court vide order dated 29.03.2022. In view of the dismissal of the writ petition of the State assailing the order dated 08.04.2016 of the Odisha Administrative Tribunal, the present matter has been rendered infructuous.

Mr. P.K. Mohanty, learned Additional Standing Counsel has no objection to the aforesaid submissions of learned counsel for the petitioner.

In view of the aforesaid submission, the writ petition stands disposed of as infructuous.
