Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Spl. G.R. Case No.249/155 of 2017-2020, pending in the Court of learned District & Sessions - cum- Special Judge under (POCSO Act) Court, Sambalpur, arising out of Charmal P.S. Case No.68/2017 dated.05.07.2017, offence under Section 376 of IPC read with Section 6 of the POCSO Act. 3.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court (under POCSO Act), Sambalpur, by order dated 30.09.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner seeks permission to withdraw this bail application to move the learned Court in seisin afresh, after examination of the victim.

Giving such liberty, the BLAPL stands disposed of as withdrawn.

6.

It is needless to state that if such an application is filed, the same shall be considered on its own merits.
