Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in connection with C.T. Case No.246 of 2022, pending in the Court of the learned J.M.F.C., M.Rampur, arising out of M.Rampur P.S. Case No.158 of 2022, for alleged commission of offences under Section 457/380 of IPC. 3.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna, by order dated 13.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel that the petitioners are in custody since 25.07.2022 and charge-sheet has been filed on 21.10.2022, hence their further continuance in custody is unwarranted, keeping in view the nature of allegation in the case at hand.

Learned counsel for the State opposes the prayer for bail of petitioner Nos.1 & 3, keeping in view their criminal proclivity. 6.

Considering the filing of the charge-sheet, this Court directs the petitioners to be released on bail. 7.

Additionally, it is directed that the petitioner Nos.1 & 3 shall appear before the jurisdictional police station once every week on such date and time to be fixed by the learned Court in seisin over the matter till conclusion of trial.

Accordingly, the BLAPL stands disposed of.
