This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This interlocutory application has been filed for modification of order dated 18.10.2022.

Learned counsel for the Petitioners submitted that in the meantime charge-sheet has been submitted. In such view of the matter, learned counsel for the Petitioners submitted that the order dated 18.10.2022 be modified and be permitted to the Petitioners to surrender before the Court below and on surrendering, he will be released on bail by the Court below.

Considering the fact that this Court had granted anticipatory bail to the Petitioners, this Court modifies the order dated 18.10.2022

// 2 // to the extent that the Petitioners surrender and move for bail before the learned S.D.J.M., Cuttack in G.R.Case No.400 of 2020 arising out of Cantonment P.S. Case No.49 of 2020 within a period of four weeks from today, they shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper in the facts and circumstances of the case.
