This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.09 of 2022, pending in the file of learned J.M.F.C., Jajpur Road, arising out of Jajpur Road P.S. Case No.03 of 2022, for alleged commission of offence under Sections 457/380/511 of IPC.

Being aggrieved by the rejection of her application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Jajpur Road by order dated 30.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.

It is submitted by the learned counsel for the petitioner that petitioner has been implicated in the case at hand on account of his criminal proclivity and he is in custody since 02.09.2022 and as investigation has progressed substantially, further continuance of the petitioner in custody is not warranted.

Learned counsel for the State opposes the prayer for bail keeping in view the criminal antecedents of the petitioner of similar nature.

Considering the basis of implication in the case at hand and period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view the criminal proclivity of the petitioner, it is directed that the petitioner shall appear before the jurisdictional police station once every week till the submission of final form. Date and time of such appearance be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
