Heard Mr. S.K. Sahu, learned counsel for the petitioners and Mr. A.K. Mishra, learned Additional Government Advocate for the State. 3.
The petitioners have filed this writ petition seeking to quash the final gradation list of MPHW (M) dated 02.07.2018 under Annexure-6. He further seeks to recast/prepare the final gradation list of MPHW (M) by including the names of petitioners in the common final gradation list of MPHW (M).

Mr. A.K. Mishra, learned Additional Government Advocate raised objection with regard to the maintainability of the Writ Petition and contended that since the persons named in the gradation list have not been arrayed as opposite parties, the writ petition suffers from non-joinder of parties.

In view of the above, since the petitioners have challenged the gradation list without impleading the persons whose names finds place in the gradation list, therefore, this writ petition suffers from non-joinder of parties and as such, this writ petition cannot sustain in the eye of law and the same stands dismissed.
