01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. Nihal Rath, learned counsel for the Petitioner and Mr. YSP Babu, learned AGA appearing for the Opp. Parties.

3. The Petitioner is aggrieved by the office order dtd.11.04.2016 passed by the Transport Commissioner -cum- Chairman, State Transport Authority, Odisha, Cuttack under Annexure-6.

4. It is submitted that the said order was passed without giving an opportunity to the Petitioner as the Petitioner's right has been squarely affected by virtue of the said order and he has been deprived from getting the benefit of RACP from the date of his entitlement. But this Court after going through the materials available on record finds that prior to assailing such action of the O.P. No. 3, the Petitioner has not made any grievance before the said Authority and he has straight away approached this Court in the present writ Petition.

5. In that view of the matter this Court while disposing the writ Petition, permits the Petitioner to approach the O.P. No. 3 by

// 2 // making a detailed representation and the reason for him being aggrieved by the said order.

6. It is observed that if any such application is filed within a period of two (2) weeks from today, O.P. No. 3 shall take a lawful decision on the same by giving a personal hearing to the Petitioner within a further period of two (2) months. The order so passed by the O.P. No. 3 be also communicated to the Petitioner by that time.

7. The writ Petition is disposed of accordingly. (Biraja Prasanna Satapathy) Judge Sneha
