This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.361 of 2017, pending on the file of the learned J.M.F.C., Niali, arising out of Niali P.S. Case No.33 of 2017 for the alleged commission of offence under Section 341/379/302/34 IPC. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned 2nd Addl. Sessions Judge, Cuttack by order dated 22.09.2022, the present BLAPL has been filed. 5.

Perused the order of rejection.

Taking into account the Petitioner was an absconder from the date of occurrence i.e. 04.03.2017 and has been apprehended after a period of five years as reflected in the order of rejection, this Court is not inclined to entertain this bail application at this stage.

Accordingly, BLAPL stands rejected.
