The Original Application No.2689 of 2018 was filed before the State Administrative Tribunal, Principal Bench, Bhubaneswar. After its abolition, the same has been transferred to this Court which is renumbered as WPC(OA) No.2689 of 2018. 2.

The Petitioner was promoted to the rank of Chief District Veterinary Officer by order dated 31st May, 2018 (Annexure-4), wherein his name figured at serial No. 3 in the said order. 3.

It is submitted by the counsel for the Petitioner that in the gradation list dated 12th June, 2018 (Annexure-5) prepared at the Level of Sub-Divisional Veterinary Officer, his name has been included whereas in the gradation list dated 2nd January, 2018 of Chief Divisional Veterinary Officer, his name was ignored. It is, therefore, submitted that the gradation list of Chief Divisional Veterinary Officer is required to be modified keeping in view the seniority based on catch up principle.

Vide order dated 28th November, 2018 while issuing notice, the learned Administration Tribunal, as an interim measure, has passed the following order:- "xxx xxx xxx So far as prayer for interim order is concerned, any promotion to the rank of OVS (Joint Director, Level-I), shall be considered only after disposal of representation of the applicant as at Annexure-7".

When the matter is called today for hearing, Mr. Biswabihari Mohanty, counsel for the Petitioner submitted that by efflux of time, the matter has been rendered infructuous. 6.

In view of the above, the writ petition is disposed of as infructuous.
