Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Spl. (POCSO) Case No.90 of 2022, pending in the file of learned Additional Sessions Judge-cum-Special Court under POCSO Act, Jajpur, Dist-Jajpur, arising out of Binjharpur P.S. Case No.469 of 2022, for commission of alleged offences under Sections 363/376-AB of IPC read with Section 6 of the POCSO Act and is in custody since 06.08.2022. 3.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge-cum-Special Judge (POCSO), Jajpur by order dated 12.10.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner seeks for withdrawal of this bail application.

Accordingly, learned counsel for the petitioner is permitted to withdraw this bail application with liberty to move the learned Court in seisin after examination of the victim and same shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

Thus, the BLAPL stands disposed of.
